These Terms of Use govern your access to and use of the PIC-ture That! website, mobile application, and related services operated by BDR Enterprise LLC.

By accessing or using PIC-ture That!, you agree to these Terms. If you do not agree, do not use the service.

1. ABOUT PIC-TURE THAT!

PIC-ture That! is a restaurant discovery and community-content platform that allows users to browse and submit food photos, menu photos, reviews, comments, votes, questions, restaurant information, and other content.

2. ELIGIBILITY

You must be legally permitted to use the service in your location.

PIC-ture That! is not directed to children under 13. Users under the age of majority in their location should use the service only with the permission and supervision of a parent or legal guardian.

3. USER ACCOUNTS

You are responsible for:

• Providing accurate account information
• Protecting your login credentials
• All activity occurring through your account
• Promptly notifying us of unauthorized account access

We may suspend, restrict, or terminate accounts that violate these Terms, create security risks, engage in abuse, or interfere with the service.

4. USER-GENERATED CONTENT

You may submit food photos, menu photos, comments, reviews, questions, votes, profile information, and other content.

You retain ownership of content you submit.

By submitting content, you grant BDR Enterprise LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, distribute, moderate, promote, and otherwise use that content for operating, improving, marketing, and providing PIC-ture That!.

This license continues for as long as the content remains on the service or is reasonably needed for backups, legal compliance, dispute resolution, or service operation.

You represent that:

• You own the content or have permission to submit it
• The content does not violate another person’s copyright, trademark, privacy, publicity, or other rights
• The content is not unlawful, deceptive, threatening, abusive, defamatory, obscene, or harmful
• The content does not contain malware, spam, or unauthorized advertising
• The content does not falsely represent a restaurant, owner, employee, or other person

5. CONTENT MODERATION

PIC-ture That! may review, approve, reject, restrict, remove, or restore submitted content.

Moderation may involve automated systems and human review.

We do not guarantee that all content will be reviewed before publication or that all prohibited content will be identified immediately.

Users may report content they believe violates these Terms or applicable law.

Google requires publishers to remain responsible for user-generated content appearing on monetized pages, so content may be removed or ads may be withheld from pages that do not meet applicable policies.

6. RESTAURANT INFORMATION

Restaurant names, addresses, menus, operating hours, prices, availability, websites, phone numbers, and other information may come from users, restaurants, third-party providers, or public sources.

This information may be incomplete, inaccurate, or outdated.

You should confirm important information directly with the restaurant before visiting, ordering, or making decisions.

7. FOOD, MENU, AND ALLERGEN INFORMATION

Food photos, menu photos, descriptions, prices, ingredients, dietary labels, and allergen information may be user-submitted, restaurant-submitted, automatically generated, or interpreted from images.

PIC-ture That! does not guarantee that any food item is safe, allergen-free, available, correctly labeled, or prepared as shown.

Ingredients, recipes, suppliers, preparation methods, and cross-contact risks may change.

Always confirm dietary and allergy information directly with the restaurant before ordering or eating.

8. RESTAURANT OWNER AND MANAGER CLAIMS

Restaurant ownership or management claims may require verification.

Submitting a claim does not guarantee approval.

We may approve, deny, suspend, or revoke access if information is inaccurate, incomplete, unverifiable, fraudulent, or no longer current.

Verified restaurant representatives are responsible for the accuracy of information they publish or edit.

9. POINTS, REWARDS, ACHIEVEMENTS, AND CHALLENGES

Points, badges, achievements, rankings, rewards, challenges, and promotional benefits:

• Have no cash value unless explicitly stated
• Are not transferable
• May be modified, limited, reversed, suspended, or discontinued
• May be withheld or removed for fraud, abuse, duplicate activity, manipulation, or policy violations

PIC-ture That! does not guarantee the continued availability of any reward system or promotional benefit.

10. ADVERTISING

PIC-ture That! may display advertisements through Google AdSense, Google AdMob, or other advertising partners.

Advertising does not constitute an endorsement of any advertiser, product, service, or claim.

We are not responsible for third-party advertisements or transactions between users and advertisers.

11. PROHIBITED CONDUCT

You may not:

• Upload content you do not have the right to use
• Impersonate another person, restaurant, or business
• Submit false restaurant ownership or management claims
• Manipulate votes, points, rewards, rankings, reviews, or challenges
• Use bots, scripts, automation, fake accounts, or deceptive techniques
• Upload illegal, violent, hateful, sexually explicit, threatening, fraudulent, or harmful content
• Harass users, restaurant staff, owners, or contributors
• Attempt to access another user’s account
• Reverse engineer, disrupt, overload, damage, or interfere with the service
• Use the service for unauthorized commercial solicitation or spam
• Violate applicable law or third-party rights

12. INTELLECTUAL PROPERTY

PIC-ture That!, its logo, branding, software, design, graphics, text, features, and original content are owned by or licensed to BDR Enterprise LLC.

You may not copy, modify, distribute, sell, license, or exploit these materials without written permission, except where permitted by law.

13. COPYRIGHT COMPLAINTS

If you believe content on PIC-ture That! infringes your copyright, contact:

Include:

• Your name and contact information
• Identification of the copyrighted work
• Identification and location of the allegedly infringing content
• A statement that you have a good-faith belief the use is unauthorized
• A statement that the information provided is accurate
• Your physical or electronic signature

14. THIRD-PARTY SERVICES AND LINKS

PIC-ture That! may contain links to restaurants, app stores, maps, websites, social networks, advertisers, and other third-party services.

We do not control and are not responsible for third-party content, security, privacy practices, availability, products, or services.

Your use of third-party services is subject to their own terms and policies.

15. SERVICE AVAILABILITY

We may modify, suspend, limit, or discontinue any part of the service at any time.

We do not guarantee uninterrupted access, error-free operation, permanent storage of content, or compatibility with every device.

16. DISCLAIMER OF WARRANTIES

PIC-ture That! is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, BDR Enterprise LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.

We do not guarantee:

• The accuracy of restaurant or menu information
• The quality or safety of food
• The accuracy of user-generated content
• The availability of restaurants, meals, prices, or promotions
• That the service will meet every user’s expectations
• That all errors or harmful content will be identified or corrected

17. LIMITATION OF LIABILITY

To the fullest extent permitted by law, BDR Enterprise LLC and its owners, officers, employees, contractors, affiliates, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.

This includes damages arising from:

• Use of or inability to use the service
• Reliance on restaurant, menu, dietary, or allergen information
• User-generated content
• Loss of data
• Unauthorized account access
• Third-party websites, advertisements, products, or services
• Restaurant visits, purchases, food consumption, illness, injury, or disputes

Some jurisdictions do not allow certain liability limitations, so some provisions may not apply to you.

18. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless BDR Enterprise LLC and its owners, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, judgments, costs, and expenses arising from:

• Your use of the service
• Your content
• Your violation of these Terms
• Your violation of law
• Your infringement of another person’s rights

19. TERMINATION

You may stop using PIC-ture That! at any time.

We may suspend or terminate access if you violate these Terms, create risk, misuse the service, or if continued access is no longer commercially or legally practical.

Termination may not automatically remove information that must be retained for legal, security, fraud-prevention, or operational purposes.

20. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

Any dispute will be handled in a court of competent jurisdiction located in Virginia, unless applicable law requires otherwise.

21. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The “Last updated” date will be changed when revisions are published.

Continued use of the service after changes become effective means you accept the updated Terms.
